You are also responsible for ensuring that all persons who access our site and/or the myDooT Services through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
Our collection and use of personal information in connection with the Services is as provided in myDooT's Privacy Policy located at http://mydoot.com/. myDooT may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, or acting as a Master Policy Holder in case of Insurance backed Services which may include a claim, involving you and a Third Party Provider (including independent third party repair service provider or independent third party logistics providers of myDooT) and such information or data is necessary to resolve the complaint, dispute or conflict or deliver Services.

myDooT Services

Access to our site gives you the option to sign up for our service (“myDooT Services”). The myDooT Services will allocate each complaint you have with service providers such as utility companies, restaurants, insurance companies and retail stores. Your email account will allow you to use our suggestions service option to identify recipients and appropriate content for any emails you send from that email account regarding that complaint.
We will not access your email account(s) without your permission or unless we have a reasonable suspicion that you may have breached the Terms of Use or Terms and Conditions or if so required under any provision of applicable law.
The Services constitute a technology platform that enables users of myDooT's mobile applications or websites provided as part of the Services (each, an "Application") to arrange and schedule purchase, repair, sell and/or logistics services through independent third party providers of such services, including independent third party sellers, independent third party buyers, independent third party repair service providers and independent third party logistics providers under agreement with myDooT or certain of myDooT's affiliates ("Third Party Providers"). Unless otherwise agreed by myDooT in a separate written agreement with you, the Services are made available solely for your personal, noncommercial use.
You acknowledge that myDooT does not provide sales services or purchase services or repair services or logistics services; or function as a seller or a purchaser or a repair service provider or logistics provider and that all such seller services or purchase services or repair services or logistics services are provided by independent third party contractors who are not employed by myDooT or any of its affiliates.

User Accounts

In order to use most aspects of the Services, you must register for and maintain an active personal user Services account ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. You shall be solely liable for any misuse of the user identification code, password or any other piece of information that will be granted to you on an exclusive basis.
You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, whether to the Third Party Provider or any other party. In certain instances you may be asked to provide proof of identity to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity. You also agree and warrant myDooT that you will not contract the Third Party Providers of myDooT or their associates to obtain any services bypassing myDooT by obtaining such Third Party Service Provider or associate details through myDooT or the Application of myDooT.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us via the contact us page

Promotional Codes

myDooT may, in myDooT's sole discretion, create promotional codes that may be redeemed for Account credit, or other features or benefits related to the Services and/or a Third Party Provider's services, subject to any additional terms that myDooT establishes on a per promotional code basis ("Promo Codes" or "Loyalty Points"). You agree that Promo Codes or Loyalty Points:

  • Must be used for the intended audience and purpose, and in a lawful manner
  • May not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by myDooT.
  • May be disabled by myDooT at any time for any reason without liability to myDooT.
  • May only be used pursuant to the specific terms that myDooT establishes for such Promo Code or Loyalty Points.
  • Are not valid for cash
  • May expire prior to your use. myDooT reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promo Codes or Loyalty Points by you or any other user in the event that myDooT determines or believes that the use or redemption of the Promo Code or Loyalty Points was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or Loyalty Points Terms these Terms.

Text Messages and Notifications

By creating an Account, you agree that the Services may send you informational text messages and notifications as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from myDooT at any time by sending an email to support@myDooT.com indicating that you no longer want to receive such messages, along with the phone number of the mobile device receiving the messages. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site and as part of our suggestions service, and in the material published on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any acorganisationing text.

Any rights not expressly granted herein are reserved by myDooT and myDooT's licensors.

Reliance & Restrictions

The contents on our site (including our suggestions service accessed via your email account) is provided for information only. It is not intended to amount to advice on which you should rely. We make it clear that contents on our site may not be considered to be legal advice and may not be construed to be legal services being rendered by us.
We would presume that the use of our site by you is only after you have perused and accepted all the terms and conditions of usage of the same and we shall not be liable for any action or inaction that you may allege on account of using our site. However, nothing in these terms of use excludes or limits our liability that cannot be excluded or limited by laws of India.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of or reliance on any content (including via the suggestions service) displayed on our site or accessible via the myDooT Services

If you are a consumer user, please note that we only provide our site and our myDooT Services for domestic and private use. Uploading content to our site

Neither these Terms nor your use of the Services convey or grant to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner myDooT's organisation names, logos, product and service names, trademarks or services marks or those of myDooT's licensors.

Indemnity

You agree to indemnify and hold myDooT and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with:

  • Your use of the Services or services or goods obtained through your use of the Services
  • Your breach or violation of any of these Terms.
  • myDooT's use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers.

Governing Law Arbitration

Except as otherwise set forth in these Terms, this Agreement shall be governed and interpreted by, and construed in accordance with, the substantive laws of India and, subject to the arbitration agreement, only the courts of Mumbai shall have exclusive jurisdiction. Both Parties hereby irrevocably agree that any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability (any "Dispute") shall be first sought to be settled by mutual discussions between you and myDooT, pursuant to a written notice sent by the Party claiming that a Dispute has arisen to the other Party involved in the Dispute, which notice shall contain the details of the Dispute. In the event that the Dispute cannot be settled by mutual discussions between the Parties within a period of 60 (Sixty) Business Days from the receipt of the notice by the other Party involved in the Dispute, the one sending the notice may commence arbitration proceedings under the (Indian) Arbitration and Conciliation Act, 1996 ("Arbitration Act"). Each Party shall be entitled to appoint (1) one arbitrator and the two appointed arbitrators shall mutually appoint a third person of repute to act as the presiding arbitrator ("Tribunal"). The language to be used in the arbitral proceedings shall be English. Any award made by the arbitrators shall be final and binding on both the Parties. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the Parties, correspondence from and to the arbitrators, correspondence from the mediator, and correspondence, orders and awards issued by the Tribunal, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless:

  • The disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and
  • The third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.
